H1B Visa Lawyer Blog Has Just Posted the Following:
The Administrative Appeals Office (AAO) Processing Times were released on June 8, 2010 with processing dates as of May 1, 2010.
If you filed an appeal, please review the links below to determine the applicable processing time associated with your particular case.

The current processing time for an I-129 H-1B Appeal is 13 months. The current processing time for an I-140 EB2 Appeal for an Advanced Degree Professional is 24 months; for an I-140EB3 Appeal for a Skilled or Professional Worker is 24 months.
Most other cases are within USCIS's processing time goal of 6 months or less.

So we got an RFE. Bummer. Some of the things were really simple things, like I missed signing in one spot... oops. Had to get a copy of my dad's birth certificate because he's supporting my husband with his income. But two of the RFEs were for taxes which I am 99% sure that I sent in for 2007 for both my father and I, so I don't know why we got an RFE for that (I just ordered the tax transcripts for all 3 years for the both of us, just to make it easier). Anyway, they also want my dad's paystubs for the last 6 months. Cool. So I went through my dads paystubs, and two of the paystubs are missing from the last 6 months - one from May and one from March

2 - You can work for multiple employers using EAD. Typically EAD will not have any restrictions other than how long it is valid for.

Hello
I'm A medical student who has come to do a 1 month internship(Clinical Elective) at a University on a F-1 visa valid till mid may 2009 .My internship here ends at the end of march. I have also 2 internships(cliinical electives) scheduled for the month of May and June as well at ANother University . The main problem is that the other univ require me to be on a B-1 and not on a F-1 . My present school has called them and requested them but they rejected the plea. They want me on B-1 . Now my question is that "Can I change my status from a F-1 to a B-1 while in US" - I have a valid visa which is not yet expired .
It would be appreciated if u can tell me about the forms that I shall need to fill in for the same ? Do I need to hire an attorney for it ?

I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?

With predictions that the H1B cap will be reached any day now, employers and employees are rushing to beat the cap. United States Citizenship and Immigration Services (USCIS) announced that, as of December 4th, it had received approximately 61,100 H-1B petitions counting toward the congressionally-mandated 65,000 limit. Additionally, USCIS has approved sufficient H-1B petitions for foreign nationals with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petition filed on behalf of a foreign national with an advanced degree will now count toward the general H-1B cap of 65,000.
So why are they still accepting cases? Well not all filed H1B petitions will be approved so the final count will not be known until USCIS will clear all denials. We will keep you posted.

The NY Times' Nina Bernstein reports on spouses of US citizens who are facing exile for technical and minor violations of their visa status. There is no mandate about that....They can come back anytime before Aug 17 as long as their PD is on or before July 31st, 2007.....Since USCIS said it will not reject 485s without medicals, you can get the medicals done later and submit when they send you an RFE....However, make sure to keep all the applications filled in and ready for mailing except for the signatures and I-94 information of the returning individuals......

I have been in the US for a couple of years working on an E-1 Visa. I am now filing my I-765 because my Visa is tied to me working for a particular company and is not transferable. I have a social security card.
I am now not sure if I should fill this out as if I am applying for a or b:
A) Permission to accept employment
B) Replacement (of lost employment authorization document)
C) Renewal of my permission to accept employment (attach previous employment authorization document). Form I-76
If it is C, should I attach a copy of my E-1 Visa and my Social Security card or something else?
Also, for question 11 (Have you ever before applied for employment authorization from USCIS)? I don't think I have. I think my E-1 Visa came with this right and that I only dealt with the social security office.
Please help if you know the answer
