Hi,
I have received notice for I-485 FP, but my I-140 is still in process (not approved or anything). How is this possible? Is it because of concurrent filing?

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

I am working on L1B and also have H1B (without I94) from another employer
I am filing L1B extension and H1B Change of Status at same time
Situation 1) My L1B Extensions paper with (I94) comes prior to H1B change of status paper (with I94),
which VISA will be applicable to me and my dependent spouse

The absence of I485 receipt may be an issue, because they would put a stamp on that paper after taking your (I485) FP. They would do the same on your EAD FP notice letter.

Effective July 9, 2010, the Department of State revised its visa reciprocity schedule for China to allow for a 12 month, multiple entry visa for H visa applicants. This will allow H-1B visa holders from China to have multiple entries into the U.S. for a 12 month period. Hi,
I was working on H1B till one month back, recetly I joined permanent position on EAD. I need to renew my wifes EAD. Though I dod not need it but for driving license they want some immigration document, so I am planning to e-file for my wife's EAD. I have couple of questions
1. There is question for Current Immigration status. I belive since I mobved to EAD my wif's status is AOS pending. But from the option I do not see any option near to that. What should be right choice. It is not a manadatory field can I leave it blank.
2. There is question for Provide information regarding eligibility status. What should i put there , I am thginking to keep AOS Pending.
3. Somebody told me that I can not e-file for my wife.
Gurus please suggest. I am waiting for your responses.

Hello forum participants.
I am a dependent on an I-485 application, with my father being the primary applicant. The application has been pending since 2001, so I decided to first threaten USCIS with a lawsuit, and then maybe file a writ of mandamus. My question is whether I have authority to do so as a dependent. Can I represent the whole family or at least myself? My father is leaving the country for some time and it will be hard for him to participate in the process.

No. You can't port PD from spouse.
You can port your own PD, if you have another EB3 approved.
You can port the country of chargeability, if she was born in another (ROW) country.
My priority date is in 10/2006 under EB3. My wife just start her GC process under EB2. Can my wife port my PD date to her GC application?

Is premium processing available for EAD?

I checked current EAD form and dont see any reference to premium processing being available

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.
