This shouldn't be a problem provided that she has the AP when she is leaving. AOS applicants don't need to be in the US while the AOS is pending, except to go to fingerprint appointments, interviews, etc. They must be in the US when the AOS is filed, and need to be careful to always have AP before leaving, but a 3-month gap should not be a problem.

I am planning to go for visa stamping soon. This will be by 7th year extension. I have the following questions. Thanks for reading my post and for replies.
1) Recently my title changed from "member of technical staff" to "senior member of technical staff" and I got a pay increase. But the job duties is the same. I don't think this needs H1 amendment. Does it ? I also hope that this will not affect the green card processing.
2) This may be a dumb question. I have the approved I-797 but the online status still shows as pending. Since I know at least one USCIS database is not updated, is there a reason to suspect PIMS delay when I go for stamping ? I am planing to go for stamping in Chennai, I assume there is no way to check beforehand. Did anyone else experience the same (online status not updated) and face any delays due to PIMS.

Hi,
Please help me out on this.
My employer provided me with substituion LC with PD: Oct 2002, EB, and filed an I140 using it last year. The RD on it is Nov 2005. The 140 had 2 RFEs both asking for submission of original LC. As per the attorney the original LC was submitted with the application, and the attorney requested the CIS to get the copy of LC from DOL, as per the regulation as she says. Now this week CIS as send a denial on this case.
My questions are:
1. The attorney says, she can no longer get the duplicate of the LC from the DOL, as it's an old substitution case. Is there any other way, or solution on this?
2. The origianal LC was filed along with the I140 petition. Is that usual? Should all the originals must have been submitted only on request?
3. Is there any way to make this case alive again? What are the chances of approval if we reopen the case.

Dear forum members,
I have a question regarding transferring my H1b. My scenario is i am on my 7th year of my H1b and it is expiring on Oct 2007. My current employer will be filing an extension of 3 years based on my approved I-140 in the month of June 2007. If everything goes well i will get my three year extension(2007-2010) by Aug 2007.
Question is
1) If i get a new job opportunity after 3 year approval ( start date will be Oct 2007) can i transfer it to my new employer by aug or i have to wait till the start date of H1 approval?
2) When can i start working for the new company?
Any response will be appreciated.

I'm planning to file GC for my parents (along with adjustment of status) when they visit me in a couple of months.
I'd a couple of questions regarding the birth certificate requirement.
They were born in Undivided India (before Aug 1947) and their place of birth is now in Pakistan. They migrated to India and have lived in a suburb of Mumbai most of their lives.
- I am planning to get affidavit of birth proving their place and DOB. Does this affidavit need to be on a Indian Govt issued stamp paper to make it look official?
- How do I get around Non availability or No record of the birth certificate requirement as their place of birth is in Pakistan. Can the municipal authorities of Mumbai issue this document?
Can somebody please help by sharing their experience if they are/were in a similar situation.

Hello All,
I just wanted to ask for your general advice. My H1B expires in July 2010 so I know I have to turn in my PERM application before then so I really have only about 2 months to start recruitment process. I also have a green card to Canada so I could go there but I do like my current job in the US and living in New York City is really great!
Anyway, my question is. How tough do you think it will be to start PERM process now in this current economic downturn and the fact that it is in New York (millions of people)? Do you also think there might be some legislation in a near future to make it more difficult for us to get green cards?
I understand you can't answer those questions exactly, but a piece of advice would be greatly appreciated. Thank you all!

The U.S. Embassy in Mexico City has suspended processing of the approximately 5100 non-immigrant visa appointments scheduled Monday, April 27 through Wednesday, April 29. In the US, All USCIS offices remain open for business. Applicants should plan to attend all previously scheduled appointments, interviews and ceremonies unless they are feeling ill. It seems that re scheduling due to illness is a perfectly acceptable reason.
There are no reports of problems to enter the US from Mexico, no refusals due to Swine Flu issues as of now. But this may well change as the issue develops.

Just saw this story from a few days ago. Aside from being a hugely irresponsible way to spend a broke state's taxpayer funds, this idea also is probably unconstitutional. Does Arizona plan on having its own border control points? Will the state's wall interfere with Border Patrol activities? The federal government is supposed to control the national borders and not the states. Not that Arizona minds wasting the state's money to continue to losing that point.

I am EB3 candidate, with estimate to get GC in 2032. Since Visa recapture bill is not on table. And is part of Immigration Reform Bill (part of reform for illegal people); considering fact that Health Care opposition, election year, 10% unemployment & other unknown factors; I do not see any hope of changing law for employment base (no hope for visa recapture).
Do seniors or admin team see any hope for EB3 candidate?

1. Where should I send the paper filing for EAD ot Nebraska or Vermont.

Hi,
I'm presently in J-2 visa and my husband is having J-1 visa.
We both are Indian Nationals. My husband applied for J-1 visa when he was in Germany.
It is mentioned in my husband's Visa clearly that "Two Year rule does NOT apply".
3 months later, I applied for J-2 from India with his visa documents.
In my visa also, it is mentioned that "Bearer is NOT subject to section 212(E). Two Year rule does NOT apply".
Now, we both want to apply for H-1B visa seperately. I want to know whether do we need to apply for H-1B waiver?
It is very much confusing since we are Indian nationals, the two year rule applies. But at the same time, as he was in in Germany while applying, it does not apply as mentioned in the visa.
Please clarify. Thanks in advance.
